How Does Mediation Work?

Unlike divorce litigation, mediation is a private matter settled behind closed doors. Instead of sitting across from each other in a courtroom, you can work with a skilled and experienced mediator who can guide you through the steps of the mediation process. This includes discussing and coming to an agreement on all of the various topics involved in your divorce. Mediation is transparent and is one of the least invasive and effective alternatives to litigation. It allows you to put your problems out in the open and get through them with an impartial mediator, allowing you to move on more easily.

Mediation can be used to resolve all types of family legal matters, including:

  • Divorce
  • Separation
  • Visitation
  • Child custody
  • Child support

Choosing the Right Mediator in Boulder

Although we have decades of experience in the field of family law, being a divorce lawyer and divorce mediator are two different roles. Not just any divorce attorney can "switch hats" so to speak and become a skilled and impartial mediator. Michael C. Morphew, Attorney at Law understands exactly what is required to mediate a divorce or family law issue by facilitating communication and helping you reach practical decisions.

How Does Litigation Work?

Michael and Ainagul work as a team. Michael provides strategy and guidance and Ainagul provides day -to-day hands-on counsel and assistance. The initial few weeks after the divorce action has been filed each party is required to share all financial information. When all financial information has been generated and exhcnaged the parties through their respsective counsel discuss and negotiate the possibility of settlement. Frequently, the part of negotiations takes place during mediation with a mutually agreed upon mediator. We work together as a team to prepare a strategy for mediation and usually at the conclusion of the mediation an agreement has been reached as to all issues. Any issues that cannot be resolved through negotiation and mediation are resolved by a Judge at the condlusion of the trial. Michael and Ainagul work together as a team in preparing for trial and appearing and representing our clients during that process.

“I met Michael through his website. He was unique in that he very clearly stated his value proposition as a family attorney. At the same time he laid out that if you wanted to have him give you an assessment of how he could help it would require a segment of time that he would need to charge for. That unique honestly, compared to offerring free evaluation, that would not have the same value, is the same honestly and integrity he employed towards navigating my issues. That seems to be a rare trait in Family law.”
